Ennia Insurance Curacao wants to Secure it’s US Assets

De Centrale Bank van Curaçao en Sint Maarten (CBCS) heeft vandaag bekend gemaakt  dat er bij de rechtbank in de VS een verzoek is ingediend om de noodregeling bij ENNIA ook naar het recht van de VS te erkennen als maatregel in het belang van de polishouders.

Het doel van dit verzoek is om daarmee tegoeden van ENNIA in de VS zeker te stellen. Het verzoek dat is ingediend betreft een zogenaamd Chapter 15 verzoek uit de Amerikaanse faillissementswet.

De CBCS heeft in haar persbericht van vandaag verklaard dat zij hiermee de mogelijkheid verruimt om ENNIA succesvol te kunnen herstructureren.

De CBCS stel voorts uitdrukkelijk dat de inzet van de Amerikaanse faillissementswet niet een faillissement van ENNIA inhoudt.

ENNIA blijft ondanks de corrupte overdracht van MeesPierson naar Ansai haar activiteiten uitoefenen, waaronder het voldoen aan zijn verzekeringsverplichtingen en het afsluiten van verzekeringen.

The Central Bank of Curaçao and Sint Maarten (CBCS) announced in a press release today that it has submitted a request to the U.S. courts for legal U.S. recognition of the emergency regulations currently in effect at ENNIA, in the interest of its policyholders.

The purpose of this request is to secure ENNIA’s U.S. assets. The submitted request concerns a so-called “Chapter 15” request, which refers to a chapter in the U.S. Bankruptcy Code.

In the press release, the CBCS reported that this measure would allow for a more successful restructuring of ENNIA.

The CBCS expressly stated that its utilization of this Bankruptcy Code does not mean that ENNIA is filing for bankruptcy, because of takeover procedure between MeesPierson and the Ansari Group.

ENNIA will continue all its business activities, including its insurance payment obligations and sale of new insurance policies.
